Geltungsbereich \/ Scope of Application<\/h3>\n<p data-start=\"613\" data-end=\"927\"><strong data-start=\"613\" data-end=\"620\">DE:<\/strong> Diese AGB gelten f\u00fcr alle Vertr\u00e4ge, Lieferungen und Leistungen zwischen Entity Handels GmbH (\u201eENTITY\u201c) und ihren Kunden. Verbraucher im Sinne des KSchG genie\u00dfen zwingende gesetzliche Rechte. F\u00fcr Unternehmer im Sinne des UGB gelten diese Bedingungen, sofern nicht schriftlich etwas anderes vereinbart ist.<\/p>\n<p data-start=\"929\" data-end=\"1316\"><strong data-start=\"929\" data-end=\"936\">EN:<\/strong> These GTC apply to all contracts, deliveries, and services between Entity Handels GmbH (\u201cENTITY\u201d) and its customers. Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) are entitled to mandatory rights. Business customers (B2B) within the meaning of the Austrian Commercial Code (UGB) are subject to these conditions unless otherwise agreed in writing.<\/p>\n<hr data-start=\"1318\" data-end=\"1321\" \/>\n<h3 data-start=\"1323\" data-end=\"1372\">2. Vertragsschluss \/ Conclusion of Contract<\/h3>\n<p data-start=\"1373\" data-end=\"1697\"><strong data-start=\"1373\" data-end=\"1380\">DE:<\/strong> Die Produktdarstellungen, insbesondere im Onlineshop oder auf Amazon, stellen kein verbindliches Angebot dar. Mit der Bestellung gibt der Kunde ein verbindliches Angebot ab. Der Vertrag kommt mit unserer schriftlichen Best\u00e4tigung oder Lieferung zustande. Online-Bestellungen erfordern die Zustimmung zu diesen AGB.<\/p>\n<p data-start=\"1699\" data-end=\"1979\"><strong data-start=\"1699\" data-end=\"1706\">EN:<\/strong> Product presentations, especially in the webshop or on Amazon, do not constitute a binding offer. By placing an order, the customer makes a binding offer. The contract is concluded upon our written confirmation or delivery. Online orders require acceptance of these GTC.<\/p>\n<hr data-start=\"1981\" data-end=\"1984\" \/>\n<h3 data-start=\"1986\" data-end=\"2034\">3. Preise und Zahlung \/ Prices and Payment<\/h3>\n<p data-start=\"2035\" data-end=\"2356\"><strong data-start=\"2035\" data-end=\"2042\">DE:<\/strong> Alle Preise sind in Euro angegeben. F\u00fcr Unternehmer exkl. USt., f\u00fcr Verbraucher inkl. USt., sofern nicht anders angegeben. Versandkosten werden separat ausgewiesen. Zahlungen sind sofort f\u00e4llig, sofern nicht anders vereinbart. ENTITY beh\u00e4lt sich vor, nur gegen Vorkasse oder sichere Zahlungsmethoden zu liefern.<\/p>\n<p data-start=\"2358\" data-end=\"2677\"><strong data-start=\"2358\" data-end=\"2365\">EN:<\/strong> All prices are stated in Euro. For business customers: net, excl. VAT. For consumers: gross, incl. VAT, unless stated otherwise. Shipping costs are charged separately. Payments are due immediately unless otherwise agreed. ENTITY reserves the right to deliver only against prepayment or secure payment methods.<\/p>\n<hr data-start=\"2679\" data-end=\"2682\" \/>\n<h3 data-start=\"2684\" data-end=\"2738\">4. Lieferung und Versand \/ Delivery and Shipping<\/h3>\n<p data-start=\"2739\" data-end=\"2999\"><strong data-start=\"2739\" data-end=\"2746\">DE:<\/strong> Lieferungen erfolgen ab Lager an die vom Kunden angegebene Adresse. Lieferzeiten sind unverbindlich, au\u00dfer ausdr\u00fccklich als Fixtermin best\u00e4tigt. Bei B2B geht die Gefahr mit \u00dcbergabe an den Spediteur \u00fcber, bei B2C erst mit \u00dcbergabe an den Verbraucher.<\/p>\n<p data-start=\"3001\" data-end=\"3273\"><strong data-start=\"3001\" data-end=\"3008\">EN:<\/strong> Deliveries are made from ENTITY\u2019s warehouse to the customer\u2019s specified address. Delivery times are non-binding unless expressly confirmed as fixed dates. For B2B, risk passes upon handover to the carrier. For B2C, risk passes only upon delivery to the consumer.<\/p>\n<hr data-start=\"3275\" data-end=\"3278\" \/>\n<h3 data-start=\"3280\" data-end=\"3328\">5. Eigentumsvorbehalt \/ Retention of Title<\/h3>\n<p data-start=\"3329\" data-end=\"3490\"><strong data-start=\"3329\" data-end=\"3336\">DE:<\/strong> Die Ware bleibt bis zur vollst\u00e4ndigen Bezahlung Eigentum von ENTITY.<br data-start=\"3405\" data-end=\"3408\" \/><strong data-start=\"3408\" data-end=\"3415\">EN:<\/strong> Goods remain the property of ENTITY until payment has been made in full.<\/p>\n<hr data-start=\"3492\" data-end=\"3495\" \/>\n<h3 data-start=\"3497\" data-end=\"3557\">6. Gew\u00e4hrleistung und Haftung \/ Warranty and Liability<\/h3>\n<p data-start=\"3558\" data-end=\"3984\"><strong data-start=\"3558\" data-end=\"3565\">DE:<\/strong> Verbraucher haben gesetzliche Gew\u00e4hrleistungsrechte (2 Jahre ab \u00dcbergabe). F\u00fcr Unternehmer betr\u00e4gt die Gew\u00e4hrleistungsfrist 12 Monate. M\u00e4ngel sind nach \u00a7 377 UGB unverz\u00fcglich zu r\u00fcgen. ENTITY haftet nur f\u00fcr Vorsatz und grobe Fahrl\u00e4ssigkeit. Leichte Fahrl\u00e4ssigkeit nur bei Verletzung wesentlicher Vertragspflichten. Haftung f\u00fcr Folgesch\u00e4den, Datenverlust oder entgangenen Gewinn ist ausgeschlossen, au\u00dfer bei Vorsatz.<\/p>\n<p data-start=\"3986\" data-end=\"4429\"><strong data-start=\"3986\" data-end=\"3993\">EN:<\/strong> Consumers have statutory warranty rights (2 years from delivery). For business customers, the warranty period is 12 months. Defects must be reported without delay in accordance with \u00a7 377 UGB. ENTITY is liable only for intent and gross negligence. For slight negligence, liability is limited to essential contractual obligations. Liability for consequential damages, data loss, or lost profits is excluded, except in cases of intent.<\/p>\n<hr data-start=\"4431\" data-end=\"4434\" \/>\n<h3 data-start=\"4436\" data-end=\"4511\">7. Widerrufsrecht f\u00fcr Verbraucher \/ Right of Withdrawal for Consumers<\/h3>\n<p data-start=\"4512\" data-end=\"4869\"><strong data-start=\"4512\" data-end=\"4519\">DE:<\/strong> Verbraucher haben das Recht, binnen 14 Tagen ohne Angabe von Gr\u00fcnden vom Vertrag zur\u00fcckzutreten. Die Frist beginnt mit Erhalt der Ware. Der Widerruf muss eindeutig erkl\u00e4rt werden (z. B. per E-Mail). ENTITY erstattet Zahlungen inkl. Standardlieferkosten binnen 14 Tagen. R\u00fccksendekosten tr\u00e4gt der Verbraucher, au\u00dfer bei Falschlieferung oder Mangel.<\/p>\n<p data-start=\"4871\" data-end=\"5239\"><strong data-start=\"4871\" data-end=\"4878\">EN:<\/strong> Consumers have the right to withdraw from the contract within 14 days without giving any reason. The period begins upon receipt of the goods. Withdrawal must be declared clearly (e.g., by e-mail). ENTITY will refund payments including standard shipping within 14 days. Return costs are borne by the consumer unless goods were faulty or incorrectly delivered.<\/p>\n<hr data-start=\"5241\" data-end=\"5244\" \/>\n<h3 data-start=\"5246\" data-end=\"5278\">8. R\u00fccksendungen \/ Returns<\/h3>\n<p data-start=\"5279\" data-end=\"5575\"><strong data-start=\"5279\" data-end=\"5286\">DE:<\/strong> R\u00fccksendungen von Unternehmern sind nur nach vorheriger schriftlicher Zustimmung m\u00f6glich. F\u00fcr Verbraucher gelten die gesetzlichen R\u00fccktrittsrechte.<br data-start=\"5434\" data-end=\"5437\" \/><strong data-start=\"5437\" data-end=\"5444\">EN:<\/strong> Returns from business customers are accepted only with prior written approval. For consumers, statutory withdrawal rights apply.<\/p>\n<hr data-start=\"5577\" data-end=\"5580\" \/>\n<h3 data-start=\"5582\" data-end=\"5620\">9. Datenschutz \/ Data Protection<\/h3>\n<p data-start=\"5621\" data-end=\"5909\"><strong data-start=\"5621\" data-end=\"5628\">DE:<\/strong> ENTITY verarbeitet personenbezogene Daten ausschlie\u00dflich gem\u00e4\u00df DSGVO. Anwendbares Recht und Gerichtsstand \/ Applicable Law and Jurisdiction<\/h3>\n<p data-start=\"5996\" data-end=\"6354\"><strong data-start=\"5996\" data-end=\"6003\">DE:<\/strong> Es gilt \u00f6sterreichisches Recht unter Ausschluss des UN-Kaufrechts. F\u00fcr Unternehmer ist Gerichtsstand Wien. F\u00fcr Verbraucher gelten die gesetzlichen Gerichtsst\u00e4nde.<br data-start=\"6166\" data-end=\"6169\" \/><strong data-start=\"6169\" data-end=\"6176\">EN:<\/strong> Austrian law applies, excluding the UN Sales Convention (CISG). For business customers, place of jurisdiction is Vienna. For consumers, statutory places of jurisdiction apply.<\/p>\n<hr data-start=\"6356\" data-end=\"6359\" \/>\n<h3 data-start=\"6361\" data-end=\"6409\">11.
